Service terms
Claude AI Service Terms
These Terms apply to transactions for the provision of Claude AI accounts and services through Uptech. Please read them carefully before placing an order, making payment or beginning to use the service.
Article 1. Definitions and scope of application
"Service Provider" means Công ty TNHH Giải Pháp Công Nghệ Uptech, which assists with the activation, handover and management of Claude AI account services in Vietnam within the scope of the transaction agreed with the Customer.
"Customer" means an individual, household business, organization or enterprise purchasing Claude AI account services from the Service Provider.
"Account" includes Claude Pro accounts owned by the Customer and Claude Team. For Claude Pro accounts owned by the Customer, the account is registered under the Customer's email address and is owned and controlled by the Customer. For Claude Team, the Service Provider assists with setting up the workspace, and the Customer is granted member access using their own email address.
These Terms become binding as soon as the Customer confirms an order, makes a bank transfer, signs a confirmation, receives the handover information or begins using the service, whichever occurs first.
Article 2. Nature of the service and limitations of liability
The Service Provider acts as a provider of assistance with the activation, payment, handover and management of Claude AI accounts in Vietnam. The Service Provider is not an official reseller authorized by Anthropic, Inc., unless otherwise documented in writing.
The Claude AI service is operated by Anthropic, Inc. in the United States. The Service Provider does not control, guarantee or accept responsibility for the continuity or stability of the Claude AI platform; changes to policies, features or prices decided by Anthropic; Anthropic's locking, restricting or terminating accounts under its own policies; or the quality, accuracy or suitability of responses from the AI model.
The Customer is required to read, understand and comply with Anthropic's Terms of Use at https://www.anthropic.com/legal/consumer-terms and the related policies published or updated by Anthropic from time to time.
Article 3. Service risks and policies selected by the Customer
Claude AI is a service operated by Anthropic and is directly subject to Anthropic's policies on accounts, supported regions, phone number verification, payment methods, IP controls and anti-abuse measures, as well as its Terms of Use. These policies may change beyond the Service Provider's control.
The Customer understands and accepts that using Claude in Vietnam carries risks of account locks, restrictions, requests for additional verification, changes to access conditions or changes to payment policies. These risks may arise even if the account was previously activated and used normally.
Before placing an order, the Customer must select and accept one of the two service policies below. Placing an order, making payment, receiving handover of the account or using the account is understood to mean that the Customer has read, understood and agreed to the corresponding policy.
- The Customer makes their own assessment of the Team plan's stability and warranty options against the need to retain long-term historical data with the individual Pro plan.
- If historical data, conversations, uploaded files or work context are important, the Customer must proactively back up the necessary content to the extent permitted by Anthropic and must not rely entirely on the Claude account.
- The Service Provider is not responsible for lost conversation history, lost files, lost context, inability to transfer data between accounts, or changes by Anthropic to data retention, access and recovery policies.
Two Claude service policy options
| Option | Features | Warranty / historical data |
|---|---|---|
| Claude Team | More stable for team use or for a service package managed by the Service Provider. If the account or workspace is locked within the scope covered by the warranty, the Service Provider may assist with replacement by a new account/workspace. | An account-lock warranty policy applies within the agreed scope. However, a new account/workspace may be required each month; historical data, conversations, files, settings or previous context may not be retained or may not be transferable to the new account. |
| Individual Claude Pro | An individual account registered under the Customer's email address, with the ability to retain history over the long term if the account is not locked and Anthropic continues to allow normal access. | More prone to account locks, with no account-lock warranty, and priced higher than Team. If the account is locked, restricted or terminated by Anthropic, the Service Provider makes no commitment to replace the account, issue a refund or restore historical data. |
Article 4. Account lock policy
3.1. Account lock incidents are classified and handled according to the nature of the incident, its cause and the Service Provider's reasonable ability to intervene.
- 3.2. Common factors that may lead to account locks, restrictions or bans include using an unstable VPN or proxy, frequent IP changes, creating content that violates Anthropic's usage policies, payment information that does not match the geographical region, sharing a Pro account among multiple users at the same time, or using automation, bots or scripts for bulk access.
- The Customer is responsible for their use of the account, access devices, network connection, input data and content generated while using Claude AI.
Incident classification and handling
| Incident type | Description / Handling |
|---|---|
| Temporary lock (Soft lock) | Usually caused by repeated incorrect password entries. The Customer unlocks the account themselves through the "Forgot password" feature via email. The Service Provider does not intervene directly in the Customer's individual account. |
| Security lock (Security hold) | Anthropic detects unusual activity. The Customer contacts support.anthropic.com. The Service Provider may provide guidance or help draft an email if needed. |
| Account ban (Permanent ban) | Anthropic terminates the account due to a suspected or confirmed breach of its Terms of Use. The refund policy applies in accordance with Article 5 of these Terms. |
Article 5. Refund policy
The refund policy applies only to the cases listed below and depends on the outcome of verifying the cause of the incident. Unless otherwise agreed in writing, fees paid are non-refundable if the Customer changes their mind, no longer needs the service or breaches Anthropic's Terms of Use.
Refund policy table
| Case | Within the first 7 days | After 7 days |
|---|---|---|
| Ban for an unclear reason or an Anthropic system error | A 100% refund or a replacement account, depending on which option the Service Provider confirms is feasible. | Refund for the remaining days, calculated on the basis of the service month still in effect. |
| Ban due to the Customer's breach of Anthropic's Terms of Use | No refund. | No refund. |
| The Customer changes their mind or no longer needs the service | No refund. | No refund. |
| Temporary lock due to an incorrect password | Refunds do not apply; the Service Provider provides free guidance on unlocking the account. | Refunds do not apply; the Service Provider provides free guidance on unlocking the account. |
Article 6. Rights and obligations of the Customer
The Customer has the right to receive an activated account for the plan ordered within the committed timeframe; to receive basic technical support throughout the term of use; and to receive a VAT (GTGT) invoice on request for a valid transaction, provided that complete invoice information is supplied in accordance with the applicable requirements.
- The Customer must strictly comply with Anthropic's Terms of Use, safety policies and current rules.
- The Customer must not share login information with third parties for customer-owned Pro accounts, and must not resell or grant usage rights beyond the agreed scope without the Service Provider's approval.
- The Customer must not use the account to create, process, distribute or support content that violates Vietnamese law, third-party rights or Anthropic's policies.
- The Customer must not use automation, bots, scripts, scraping or bulk-access mechanisms to exploit the account beyond normal use.
- The Customer must immediately notify the Service Provider of technical incidents, security alerts, suspected unauthorized access or unusual changes relating to the account.
Article 7. Confidentiality
The Service Provider undertakes not to proactively collect, store, read, copy or share the contents of the Customer's conversations with any third party, unless the Customer requests assistance in writing or the law provides otherwise.
For Pro accounts owned by the Customer, the Customer has full control over the email address, password and data after handover. The Service Provider does not access the account after handover, unless the Customer voluntarily provides access for technical support.
For Team accounts, the Service Provider may retain admin rights to assist with setup, technical matters, and adding or removing members within the scope of the service. The Service Provider undertakes not to read, copy or disclose the contents of members' conversations.
The Customer is responsible for keeping their personal login information, devices, the email account used to receive verification codes and verification methods secure, and for all activity arising from their account.
Article 8. Payment and renewal
Service prices are quoted in VND and include VAT if the parties agree that the transaction includes a VAT (GTGT) invoice. Prices may be adjusted in line with fluctuations in the USD/VND exchange rate, platform fees, international payment costs and Anthropic's pricing policies at the time of quotation or renewal.
The Service Provider gives at least 7 days' notice of any price change for the next renewal term, except where sudden changes arise from Anthropic, the payment gateway, exchange rates or legal compliance requirements.
The service does not renew automatically. The Customer must proactively contact the Service Provider to renew before expiry. The Service Provider may send a reminder 5 days before expiry through the registered contact channel.
Access to an account that expires without renewal may be suspended. Data in a Team workspace is retained for up to 30 days after expiry, unless Anthropic applies a different policy or the Customer makes a separate handling request confirmed by the Service Provider.
Article 9. Limit on compensation
The Service Provider's total liability for compensation in all circumstances does not exceed the amount paid by the Customer for the current service term directly related to the incident.
The Service Provider is not liable for indirect, incidental, consequential or special damages, including but not limited to data loss, lost revenue, lost profit, business interruption, reputational harm or replacement costs arising from interruption, restriction or changes to the Claude AI service.
Force majeure events include but are not limited to changes in Anthropic's policies, incidents affecting Anthropic's technical infrastructure, changes in Vietnamese legal requirements for cross-border digital services, internet disruptions, widespread cyberattacks, natural disasters, war, strikes or decisions of competent state authorities.
Article 10. Termination of service
The Customer may request termination of the service at any time. Service fees paid are non-refundable, except in the cases specified in Article 5 or under a separate written agreement between the parties.
- The Service Provider has the right to terminate the service immediately without a refund if the Customer breaches Anthropic's Terms of Use and this results in an account ban.
- The Service Provider has the right to terminate the service if the Customer uses it for purposes that violate Vietnamese law, infringe third-party rights or create legal risks for the Service Provider.
- The Service Provider has the right to terminate the service if the Customer deliberately harms the system, workspace, operating processes or other Customers.
Article 11. Dispute resolution
The parties give priority to resolving disputes through direct negotiation within 15 days of the date on which one party gives written notice of the dispute.
If no agreement is reached, the dispute will be resolved by the competent People's Court in accordance with the laws of the Socialist Republic of Vietnam.
Article 12. General provisions
These Terms may be updated to reflect changes in the service, Anthropic's policies, operating processes, legal requirements or the Service Provider's scope of support. The latest version will be communicated or provided to the Customer before it takes effect, except where an immediate update is required to comply with the law or platform policies.
If any provision is declared invalid by a court or competent authority, the remaining provisions remain fully enforceable to the extent permitted by law.
The Service Provider's failure to enforce a particular right at a given time does not constitute a waiver of that right or of the right to enforce it in the future.
By placing an order, making payment, receiving handover of the account or using the service, the Customer confirms that they have read, understood and agreed to the full contents of these Service Terms.
